TERMS OF SERVICE — STRETCH

These Terms of Service apply to all purchases, offers, quotations, and agreements made through the STRETCH website. By using this website or placing an order, you agree to the following terms.

1. Definitions

  • STRETCH: trade name of Marhein Holding B.V., located at De Langeloop 10J, 1742 PB Schagen, the Netherlands, Chamber of Commerce 71599320.
  • Customer: any natural or legal person who enters into an agreement with STRETCH or requests a quotation.
  • Consumer: a natural person not acting in the course of a profession or business.
  • Business Customer: a natural or legal person acting in the course of a profession or business.
  • Product: a STRETCH Reformer or related accessory.
  • Agreement: any agreement between STRETCH and the Customer, including purchase, lease, and installation services.

2. Applicability

These Terms of Service apply to all offers, quotations, and agreements between STRETCH and the Customer, unless agreed otherwise in writing.
Customer terms and conditions are expressly rejected.
Deviations are only valid if agreed in writing.

3. Offer and Prices

All offers and prices from STRETCH are non-binding and include VAT unless stated otherwise.
Prices for business customers may vary based on volume or quotation.
Obvious errors or mistakes do not bind STRETCH.
STRETCH reserves the right to change prices unless an agreement has already been concluded.

4. Ordering and Payment

  • Consumers can pay via iDEAL or other payment methods offered on the website.
  • Business customers pay 50% upon order and 50% upon delivery, unless agreed otherwise in writing.
  • STRETCH retains ownership of all products until full payment has been received (retention of title).
  • In case of late payment, the Customer is in default, and STRETCH may charge statutory interest and collection costs.

5. Delivery

Delivery takes place at the address provided by the Customer in the Netherlands or Belgium.
Standard delivery is curbside delivery. Installation or indoor placement can be arranged for an additional fee.
Delivery time:

  • If in stock: within 2 days
  • If made to order: 3–4 months

Risk of damage or loss lies with STRETCH until the moment of delivery to the Customer.
Exceeding the delivery time does not entitle the Customer to cancellation or compensation unless the delay is unreasonably long.

6. Right of Withdrawal (Consumers)

Consumers have the right to withdraw from the agreement within 14 days after receiving the product, without providing any reason.
Notification must be made in writing within 14 days via:

Return costs are charged to the consumer and must be paid in advance.
STRETCH arranges the return logistics.
Returns are accepted only if the product is in original condition and packaging.
The right of withdrawal does not apply to custom-made products.

7. No Return Rights (Business Customers)

Business customers cannot return products, and no refunds will be issued, unless agreed otherwise in writing.

8. Lease Agreement

In the case of leasing, the product remains the property of STRETCH during the entire lease period.
The Customer is responsible for correct use and proper maintenance.
Damage or defects caused by incorrect use are at the Customer’s expense.
The lease agreement ends automatically after the agreed period or may be terminated due to non-payment.

9. Warranty

STRETCH provides:

  • 5-year warranty on the frame
  • 1-year warranty on moving parts

Warranty does not apply to:

  • Normal wear and tear
  • Misuse
  • Incorrect assembly by third parties
  • Improper maintenance

STRETCH will decide whether to repair, replace, or offer an alternative.
Warranty is non-transferable without written permission from STRETCH.

10. Use and Liability

Use of STRETCH products is entirely at the user’s own risk.
STRETCH is not liable for personal injury, damage, or consequential damage arising from use of the product.
Liability is in all cases limited to the purchase price of the product concerned.

11. Force Majeure

In the event of force majeure (e.g., war, strike, fire, natural disaster, pandemic, government measures, transport problems), STRETCH is not obliged to fulfil its obligations.
Deliveries may be postponed or cancelled without entitlement to compensation.

12. Applicable Law and Disputes

All agreements with STRETCH are governed exclusively by Dutch law.
Disputes will be submitted to the competent court in Noord-Holland, unless mandatory law provides otherwise.
Consumers may submit disputes to the court in their place of residence.

13. Use of Website (Acceptable Use Clause)

By using this website, you agree that you will:

  • Not use the website for unlawful purposes
  • Not attempt to commit fraud, unauthorised payments, or unauthorised access
  • Not interfere with the website’s security or functionality
  • Provide accurate and complete information when placing an order
  • Not engage in behaviour that could damage STRETCH or its customers

STRETCH reserves the right to refuse service or cancel orders in cases of suspected fraud or misuse.
